As co-founder of a successful mass-marketed medical device company, she understands the daily issues consumer product and healthcare companies face. Her health practice includes advising on transactional matters, risk management, regulatory compliance, 510(K)/PMA filings and representation in audits, investigations, enforcement actions and litigation – as well as operational issues including: labeling/advertising, employment agreements, HIPAA/anti-kickback issues, commercial leases, partnership agreements and mergers and acquisitions. Her comprehensive method ensures compliance and provides clients peace of mind that expert assistance is available on day-to-day matters.
Heather has licensed countless technologies and products and successfully trademarked and protected international brands through IP maintenance, cease and desist settlements and, when necessary, injunctions and litigation. She also provides clients ongoing trade secret protection – a crucial function as many commercial assets (customer/vendor lists, business practices, social media, advertising strategies, etc…) are not protected by patent, copyright or trademark laws and can only be protected as long as they meet the stringent legal trade secret definition.
She also counsels communities, businesses, trade associations, political action committees and candidates on ballot access, campaign finance, political strategy and tactical election law. She has advised candidates, campaigns and conducted ballot recounts in California, Minnesota, Florida, Hawaii, Illinois, Massachusetts and Texas and has spoken at political and election law seminars throughout the United States.
Prior to founding her own firm, Heather worked for two White House administrations and held several corporate board seats, including Citizens Bancorp, Inc. (acquired by Community First
Bankshares, Inc. (CFBX) now BNP Paribas), throughout their acquisitions. She has lived in Beijing (where she studied law at China University of Politics and Law), Hong Kong, London, Washington D.C., Los Angeles, Chicago and San Francisco, and her commentary has appeared in the New York Times, the Financial Times, The New York Observer, San Francisco Chronicle, Marin Independent Journal, Sacramento Bee and on KRON and KTVU. She wrote the popular “Reality Check” column for TraderDaily.com and Dealmaker.com and remains a contributor to The New York Observer newspaper. She is a founder and board member of medical device manufacturer Sleep Science Partners, Inc. and consumer products brand The Pure Sleep Company, and she is a past board member of the St. Francis Yacht Club and the Republican National Lawyers Association. A competitive offshore sailor, she has raced worldwide in grand prix regattas including the Transpac, Fastnet Race, Newport-Bermuda, Chicago-Mac, Pacific Cup, TP52 Worlds, Middle Sea Race and the Rolex Maxi Worlds.
